La majeure partie des auteurs est d\u2019avis que cela n\u2019est pas possible sans le consentement pr\u00e9alable des personnes concern\u00e9es. Prudence donc. Le candidat et\/ou l\u2019employ\u00e9 peuvent en effet requ\u00e9rir \u00e0 tout moment des renseignements sur les donn\u00e9es le concernant que vous d\u00e9tenez et faire rectifier ou effacer celles qui sont erron\u00e9es.<\/p>\n<p>Il arrive de plus en plus fr\u00e9quemment que les candidats doivent pr\u00e9senter un extrait du casier judiciaire. Cette exigence s\u2019av\u00e8re probl\u00e9matique et souvent disproportionn\u00e9e. Un tel extrait ne peut \u00eatre requis que s\u2019il est absolument indispensable \u00e0 l\u2019exercice d\u2019une fonction. Lorsque les donn\u00e9es du casier judiciaire ne le sont pas, exiger syst\u00e9matiquement un extrait est inadmissible, sous l\u2019angle de la protection des donn\u00e9es d\u00e9j\u00e0. Cette exigence est \u00e9galement contraire au principe de resocialisation sur lequel se fonde le syst\u00e8me p\u00e9nal suisse. Finalement, un tel extrait est un instantan\u00e9 et ne garantit qu\u2019une transparence partielle.<\/p>\n<p>La plus grande prudence doit \u00eatre observ\u00e9e relativement aux donn\u00e9es m\u00e9dicales, car il s\u2019agit de donn\u00e9es sensibles. L\u2019employeur n\u2019a notamment pas le droit de demander des renseignements sur l\u2019\u00e9tat de sant\u00e9 d\u2019une personne, sauf si une affection pourrait compromettre l\u2019exercice de l\u2019activit\u00e9 (exemple: un peintre allergique \u00e0 certaines substances contenues dans les produits utilis\u00e9s).
